Article 53 of the UAE Arbitration Law provides that an application for the nullification of an arbitral award must be submitted within 30 days from the day the award was served to the party seeking nullification. Furthermore, during the process of the Appeal Court reviewing an application for the ratification of the award, the arbitral award can also be contested.
As stated in Article 53, the grounds for nullification include a range of situations, such as the unenforceable arbitration agreement, a lack of capacity by a party to enter into the arbitration agreement, or the Arbitration Panel overstepping its jurisdiction. Additionally, if the dispute’s subject matter is unsuitable for arbitration or if the award goes against the UAE’s public order or morality, the Appeal Court has the authority to independently declare the award as null and void.
