    Federal Law No. 28 of 2005, also known as the Personal Status Law, regulates various personal matters, including marriage, divorce, fostering, capacity (the ability to enter contracts except when restricted by law), tutelage, guardianship, testaments (wills), and succession and inheritance.

    What is the Article 154 of the personal status law?

    Article 154 of the Personal Status Law addresses the visitation rights of a noncustodial parent with their children. The custodian and noncustodial parent must agree on the visitation details, including the venue, time, and the person responsible for transporting the children. In case of disagreement, the judge steps in to resolve conflicts.

    Furthermore, the custodian is prohibited from relocating with the children to a different city within the state if such a move negatively impacts the children’s education, inconveniences the other parent, or increases visitation-related expenses. Such actions jeopardize the custodial arrangement and may result in losing custody of the children.
