Arbitration Law under DIAC include:

Enforceability of Arbitration Agreements:

The UAE Arbitration Law recognizes the enforceability of arbitration agreements, allowing parties to choose arbitration as the preferred method for resolving disputes. DIAC is a prominent institution that administers such arbitrations.

Arbitral Tribunals:

Arbitration proceedings, often administered by DIAC, involve arbitral tribunals comprising arbitrators chosen by the parties. This selection process ensures that the tribunal possesses the necessary expertise for a fair and informed resolution.

Arbitration Procedures and DIAC Rules:

The arbitration procedures, whether initiated by the parties or under the auspices of DIAC, can be tailored to the specific needs of the dispute. DIAC has established rules that govern the arbitral process, ensuring clarity and efficiency.

Confidentiality and DIAC's Role:

Arbitration proceedings, particularly those managed by DIAC, benefit from confidentiality, providing parties with a level of privacy not always available in traditional court settings. DIAC's involvement emphasises the efficiency and confidentiality of the arbitration process.

Arbitration Awards and DIAC Recognition:

Awards rendered by arbitral tribunals, often under the administration of DIAC, are final and binding. The UAE Arbitration Law provides for the recognition and enforcement of these awards, contributing to the efficacy of the arbitration process.

Interim Measures and DIAC Procedures:

DIAC, in line with international best practices, allows for the grant of interim measures or preliminary orders by arbitral tribunals to safeguard the rights of parties during arbitration proceedings.

Challenge and Annulment of Awards:

The UAE Arbitration Law, including DIAC procedures, outlines limited grounds for challenging or seeking the annulment of arbitral awards, reinforcing the finality and effectiveness of the arbitration process.

International Arbitration and DIAC's Global Recognition:

The UAE, including DIAC, is a signatory to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, streamlining the international recognition and enforcement of DIAC-administered awards.

How does arbitration work in the UAE?

Arbitration in the UAE is governed by Federal Law No. 6 of 2018, also known as the UAE Arbitration Law. It follows a similar process to other international arbitration laws, with parties agreeing to resolve their disputes through arbitration instead of traditional litigation.

An arbitration agreement is required for a dispute to be resolved through DIAC arbitration. This agreement outlines the terms and procedures for the arbitration process.

How long does DIAC arbitration take?

The duration of DIAC arbitration depends on the complexity of the case, cooperation between parties, and the number of witnesses and evidence presented.

What is the arbitration clause in the UAE?

The arbitration clause in the UAE is a contractual provision that stipulates the parties’ agreement to resolve any disputes through arbitration. It typically outlines the rules and procedures to be followed in case of a dispute, such as selecting an arbitral institution like DIAC, appointing arbitrators, and determining the governing law for the proceedings. Including an arbitration clause in contracts is common practice in the UAE to ensure a more efficient and confidential resolution of disputes.

What is Article 53 of the UAE arbitration law?

Article 53 of the UAE Arbitration Law provides that an application for the nullification of an arbitral award must be submitted within 30 days from the day the award was served to the party seeking nullification. Furthermore, during the process of the Appeal Court reviewing an application for the ratification of the award, the arbitral award can also be contested.

As stated in Article 53, the grounds for nullification include a range of situations, such as the unenforceable arbitration agreement, a lack of capacity by a party to enter into the arbitration agreement, or the Arbitration Panel overstepping its jurisdiction. Additionally, if the dispute’s subject matter is unsuitable for arbitration or if the award goes against the UAE’s public order or morality, the Appeal Court has the authority to independently declare the award as null and void.

What are the three types of arbitration?

The three main types of arbitration are ad hoc, institutional, and fast track. Ad hoc arbitration is when the parties involved in a dispute agree to resolve it through arbitration without involving any specific arbitral institution. Institutional arbitration, on the other hand, involves an established arbitral institution that provides administrative support and sets rules for the proceedings. Fast track arbitration involves accelerating the arbitral process to resolve the matter within the shortest practical timeframe. If the time limit expires without resolution, the arbitrator’s decision is void unless the court extends the deadline.
